MASTER TERMS & CONDITIONS OF SERVICE & BOOKING

By using our Service, you agree to be legally bound by these Terms.

0. U.S. DEPARTMENT OF TRANSPORTATION (DOT) AVIATION DISCLOSURES

This Section applies to air transportation to, from, or within the United States.

0.1 Full Fare Advertising

Airfares displayed by Wizfair are intended to include mandatory government-imposed taxes and fees required to purchase the ticket through the displayed channel. Optional services (baggage, seat selection, priority boarding, meals, insurance, etc.) are not included unless specifically stated.

0.2 Ancillary Fees

Airlines may charge additional fees for baggage, seats, changes, cancellations, and other optional services. Such fees vary by airline and fare class and may change at any time. Wizfair does not guarantee the accuracy of airline ancillary fee information.

0.3 24-Hour Cancellation / Hold (When Applicable)

Certain airlines may offer 24-hour cancellation or hold options in accordance with U.S. DOT regulations and/or airline policy. Eligibility depends on airline policy, fare conditions, timing, and other requirements.

0.4 Overbooking & Denied Boarding

Airlines may overbook flights. Compensation rights for involuntary denied boarding are governed by airline policy and applicable law.

0.5 Airline Customer Service Plans

Airlines maintain their own customer service plans, tarmac delay contingency plans, and disability accommodation policies. These are administered by the airline.

ACCEPTANCE OF TERMS
1.1 Binding Agreement

These Terms, together with:

  • Your Booking Confirmation
  • Applicable Supplier Rules and Restrictions
  • Any optional add-on selections
    constitute the entire legally binding agreement between you and Wizfair.
1.2 Methods of Acceptance

You accept these Terms by:

  • Accessing or browsing the Service
  • Booking online
  • Booking over the phone
  • Authorizing payment via payment link
  • Providing electronic confirmation

Electronic acceptance has the same force as a physical signature.

1.3 Updates to Terms

We may update these Terms at any time. Updated Terms apply to:

  • All future bookings
  • Continued use of the Service after publication
1.4 Additional Important Notice (U.S. Disputes)

These Terms contain arbitration and class action waiver provisions applicable to claims brought against us in the United States. Please review Section 20 carefully.

DEFINITIONS
For purposes of these Terms:
  • “We,” “us,” or “our” refers to Wizfair LLC.
  • “Service” refers to our websites, applications, online tools, phone/email/chat channels, and related services enabling travel information and bookings.
  • “Travel Provider” or “Supplier” means the supplier of Travel Services (e.g., airlines, hotels, car rental companies, cruise lines, tour operators).
  • “Travel Services” include flights, accommodations, car rentals, cruises, tours/activities, packages, and related travel experiences made available through our Service.
  • “Booking Confirmation” means the email (or other written/electronic confirmation) confirming the booked Travel Services and price.
  • “Rules and Restrictions” means the Supplier’s terms, fare rules, cancellation policies, change fees, refund rules, eligibility conditions, and other restrictions applicable to a booking.
  • “You” means the person accessing the Service and/or making bookings, including any person booking on behalf of others.
3. ABOUT WIZFAIR
3.1 Nature of Business

Wizfair is a global travel services provider primarily selling airline tickets. We also facilitate:

  • Flights (domestic & international)
  • Hotels and accommodations
  • Car rentals
  • Cruises
  • Vacation packages
  • Tours and activities
  • Optional add-on services
3.2 Jurisdiction

Wizfair is headquartered in New Jersey, USA and serves customers worldwide.

3.3 Registrations and Memberships

Wizfair maintains industry and regulatory registrations including:

  • IATA Accredited (where applicable)
  • CLIA Member
  • ASTA Member
  • California Seller of Travel CST# 2157632-40
  • Florida Seller of Travel Ref. No. ST44831
  • Washington UBI: 605586497 001 0001

These registrations do not create liability for supplier actions.

3.4 STATUTORY SELLER OF TRAVEL NOTICES

California Notice: Wizfair LLC is registered as a Seller of Travel with the State of California (CST# 2157632-40). Registration does not constitute approval by the State of California.
Florida Notice: Wizfair LLC is registered with the State of Florida as a Seller of Travel. Registration No. ST44831.

4. USING OUR SERVICE
4.1 Purpose and Authorized Use

Wizfair provides the Service to help you locate Travel Services and make bookings. You may use our Service for personal, non-commercial use unless we have agreed otherwise in writing.

By using our Service, you confirm:

  • You are at least 18 years old and have legal capacity to enter binding agreements.
  • You will use the Service in accordance with these Terms and applicable laws.
  • Information you provide is accurate, current, and complete.
  • If you create an account, you will keep credentials confidential and are responsible for activity under your account.
  • If you book for others, you will obtain their authorization, inform them of applicable terms (including Rules and Restrictions), ensure they agree, and accept responsibility for payments, changes, cancellations, and related matters.
4.2 Prohibited Actions

You agree not to:

  • Make false or fraudulent bookings.
  • Use automated tools (robots, scrapers) or manual processes to access/copy/monitor the Service without express permission.
  • Bypass security measures or interfere with the Service.
  • Impose an unreasonable load on our infrastructure.
  • Deep-link, frame, mirror, or incorporate any part of the Service into another website without prior written permission.
4.3 Access, Modifications, and Discontinuation

We may deny access to the Service for any lawful reason. We may improve, modify, suspend, or discontinue any aspect of the Service at any time.

4.4 Account Management and Deletion

To create an account you must be 18+. If you delete your account, certain data may still be retained as required for legal, tax, fraud prevention, dispute, and recordkeeping purposes (see Privacy Policy).

4.5 How We Order Search Results

We strive to show relevant results. Default sorting may be adjusted using filters (price, reviews, etc.). Paid listings may appear and will be labeled as “Ad” or similar.

4.6 Redirection and Third-Party Booking Services

Our Service may redirect you to third-party booking platforms (e.g., certain car rentals or services). Bookings made on third-party sites are between you and that third party; their terms govern those bookings and Wizfair is not liable for them.

5. OUR ROLE AND AGENCY LIMITATIONS
5.1 Intermediary Status

Wizfair acts solely as an independent travel agency and booking intermediary. We are not:

  • An airline
  • A hotel operator
  • A cruise line
  • A vehicle rental company
  • A tour operator
5.2 Merchant of Record

For the majority of transactions, especially airline tickets, Wizfair acts as the Merchant of Record.

Payments may be collected:

  • Online
  • Over the phone
  • Via secure payment link
  • Through authorized third-party payment processors

Your billing descriptor may reflect a processing partner.

In certain “Pay Later” transactions, the Supplier may charge you directly.

5.3 No Operational Control

Wizfair does not control:

  • Flight schedules
  • Aircraft type
  • Airline crew decisions
  • Hotel room assignments
  • Cruise itineraries
  • Vehicle availability
  • Weather events
  • Supplier insolvency
SUPPLIER RULES AND RESTRICTIONS
6.1 Incorporation of Supplier Rules

All bookings are subject to Supplier Rules including:

  • Fare conditions
  • Cancellation policies
  • Change penalties
  • Refund eligibility
  • No-show rules
  • Check-in requirements
  • Documentation requirements
  • Baggage policies

Supplier Rules prevail where conflicts exist.

6.2 Consequences of Non-Compliance

Failure to comply may result in:

  • Cancellation without refund
  • Denied boarding or check-in
  • Loss of unused services
  • Additional penalties

Wizfair is not liable for supplier enforcement decisions.

CONFIRMING A BOOKING

After you make a booking, we will send a Booking Confirmation to the email you provided. If you do not receive it within 24 hours, contact us promptly.

8. BOOKING CONFIRMATION & CUSTOMER RESPONSIBILITY
8.1 Immediate Review

You must immediately verify:

  • Passenger names
  • Travel dates
  • Destinations
  • Fare class
  • Flight numbers

Errors may result in denied boarding and non-refundable penalties.

8.2 Failure to Receive Confirmation

If confirmation is not received within 24 hours, contact us.

9. PAYMENT TERMS
9.1 Price

The price of Travel Services is as displayed, except in cases of obvious error. If an obvious error is discovered, we may:

  • Offer you the option to proceed at the correct price, or
  • Cancel the booking without penalty (to the extent not already ticketed/settled under Supplier rules).
9.2 Taxes

Prices may include taxes or tax recovery charges. Actual tax amounts may differ based on time, location, and applicable tax laws. Tax rates may change between booking and travel; you may be required to pay increased taxes/fees at time of service.

9.3 Authorization

By providing payment details, you:

  • Confirm authorization to use the payment method
  • Authorize immediate charge
  • Agree not to dispute valid charges
9.4 Payment Processing and Multiple Transactions

For certain bookings (including Packages), payment may be collected in multiple transactions and may appear as charges from more than one entity. Total charges will not exceed the total confirmed price of the booked Travel Services.

9.5 Payment Verification

You authorize Wizfair and/or the Supplier to verify your payment method by pre-authorization, nominal charge, or other verification methods, and upon verification, to charge for the booking amount.

9.6 Fraud Prevention and Sanctions Screening

We may request additional information if we suspect fraud, abuse, suspicious activity, or involvement with sanctioned individuals/entities. We may cancel bookings, close accounts, and pursue legal remedies if reasonably necessary.

9.7 Currency & Bank Fees / Currency Conversion

Wizfair is not responsible for:

  • Exchange rate fluctuations
  • Card issuer fees
  • Cross-border charges
    Currency conversion rates shown are informational and may fluctuate.
9.8 Alternative Payment Methods

We may offer alternative payment options (e.g., via consumer finance companies). Your use of such methods is governed by that provider’s terms; Wizfair is not responsible for their actions/omissions.

9.9 PAYMENT PROCESSORS & RISK CONTROLS 

Wizfair may use third-party processors, fraud tools, and merchant providers.

9.9.1 Verification

We may require:

  • Government ID
  • Address verification
  • Card verification
  • Additional documentation

Failure to provide requested verification within 24 hours (or sooner if travel is imminent) may result in cancellation.

9.9.2 Multiple Transactions / Authorizations

Charges may appear as:

  • Single charge
  • Multiple charges
  • Authorization then capture
  • Incremental or re-authorizations

Total charges will not exceed confirmed amount.

9.9.3 Processor Holds

Banks/processors may place holds or delays outside Wizfair’s control. Wizfair does not control bank release timing.

9.9.4 Chargeback Evidence

Wizfair may submit booking logs, IP/device logs, call recordings (where lawful), payment-link acceptance proof, email/SMS confirmations, and Supplier documentation in dispute proceedings.

9.10 PAYMENT AUTHORIZATION, ACKNOWLEDGMENTS, AND ELECTRONIC SUBMISSION 

By authorizing payment, you additionally agree that:

  1. You certify you are an authorized user of the payment method and agree not to dispute valid transactions aligned with these Terms.
  2. You have reviewed trip details and acknowledge Wizfair is not the direct Supplier; dissatisfaction with Supplier performance is not grounds for charge reversal.
  3. You agree to Supplier cancellation terms; Supplier penalties remain enforceable even in event of a chargeback.
  4. You are responsible for valid travel documents (passports, visas, proof of citizenship) and compliance with check-in requirements (generally arriving at least two (2) hours before scheduled flight, subject to airline rules).
  5. You must meet payment deadlines; late payments may result in forfeiture of deposits and/or cancellation. Wizfair service fees are non-refundable and not subject to chargebacks unless required by law.
  6. Electronic submission constitutes execution as if signed in person; if you initiate a chargeback to avoid agreed fees, you agree you may be liable for cancellation fees, attorney fees, and costs incurred by Wizfair as permitted by law.
  7. You consent to use/sharing of personal information as necessary to facilitate travel; Wizfair is not responsible for third-party use after lawful sharing for service delivery.
10. CANCELLATIONS & CHANGES

Changes are subject to:

  • Supplier rules
  • Airline penalties
  • Fare differences
  • Wizfair service fees

No-show may void remaining services.

10.1 Free Cancellation Policy (Where Applicable)

This clause applies only where permitted by law, DOT policy, and/or airline rules, and may be limited by ticketing status and fare type:

  • United States: You may be able to cancel without penalty within 24 hours of purchase if scheduled departure is at least 7 days (168 hours) away at time of booking.
  • Canada: Cancellations without penalty may be allowed until 11:59 PM EST on the day the booking was made, regardless of departure date, where applicable.

If there is a conflict, the airline/Supplier’s applicable rule and the governing law control.

10.2 Cancellation/Change by You 

You do not have an automatic right to cancel or change unless permitted by Supplier Rules and Restrictions. Suppliers may charge fees and impose restrictions. If you change a booking, the new arrangement may be subject to different (often higher) pricing.

Examples:

  • If you fail to cancel within a property’s cancellation window, you may be charged.
  • Some properties do not allow any changes or cancellations once booked.
  • Pay Later no-shows may trigger no-show/cancellation charges.
  • If you do not use some/all booked services, refunds (if any) are subject to Rules and Restrictions.
  • If multiple travelers are on one booking, cancellation charges may apply per traveler.
  • Wizfair may charge an administration/service fee for processing; you will be informed before finalizing.
10.3 Other Cancellations or Changes

A booking may be cancelled if full payment or applicable fees are not received when due. Suppliers or Wizfair may need to cancel/modify due to overbooking, closures, or unforeseen events; we will make reasonable efforts to notify you and offer alternatives if possible.

11. REFUND POLICY

Refund eligibility is determined solely by Supplier rules.

If approved:

  • Request submitted within 5 business days
  • Supplier processing may take up to 12 weeks
  • Wizfair processes refund within 7 business days after funds received

Service fees and add-ons are non-refundable unless explicitly stated or required by law.

11.1 Refund Method

Refunds, if any, are processed to the original payment method, issued by the party that originally received your payment. Wizfair may not have visibility into Supplier internal timelines.

12. OPTIONAL ADD-ON SERVICES (AND FARE UPGRADES)

Optional add-ons enhance support but do not modify Supplier rules.
All add-ons:

  • Apply per traveler
  • Are non-transferable
  • Do not eliminate Supplier penalties
  • Are non-refundable once purchased (unless stated otherwise)
12.1 FlexiFly

FlexiFly reduces or waives certain Wizfair service fees related to voluntary changes or cancellations. Benefits may include:

  • Waived Wizfair change service fee (standard fee up to $125 per traveler)
  • Reduced Wizfair cancellation service fee
  • Seat selection assistance (subject to airline availability)
  • Upgrade processing without additional Wizfair handling fee

Airline penalties and fare differences still apply.
FlexiFly fee is non-refundable once purchased.

12.2 FlexiFly Plus

Includes all FlexiFly benefits plus:

  • Priority handling
  • Enhanced assistance securing airline credit
  • Ongoing fare review prior to departure
  • Dedicated support access

FlexiFly Plus does not guarantee refunds or fare reductions.
Non-refundable once purchased.

12.3 Price Drop Protection 

Valid for 24 hours after ticket issuance.
If a lower publicly available fare for the identical itinerary is verified within 24 hours, Wizfair may issue eligible savings as a Wizfair Travel Voucher.
No cash refunds. Subject to airline rules and availability. Non-refundable fee.

12.4 Automatic Check-In

Best-effort service. Does not guarantee:

  • Seat assignments
  • Boarding priority
  • Upgrades
  • Successful check-in if airline restrictions apply

Non-refundable once check-in window opens.

12.5 Flight Text Alerts

Provides SMS updates. Message and data rates may apply. Reply STOP to opt out. Non-refundable.

13. POST-TICKETING SERVICE FEES (SERVICE FEE SCHEDULE & TERMS)

Wizfair’s Post-Ticketing Service Fees (“Service Fees”) may apply when you request modifications after ticket issuance. These Service Fees cover administrative work for cancellations, refunds, exchanges, waivers, name corrections, special service requests, and obtaining future credits.

(F) Reasons Where Agent Assistance Fees May Apply (Examples)

Death/Bereavement, Duplicate booking, Medical, Name Change, Name Correction, No Show, Routing Changes, UNMR, Visa Issues, Denied Boarding.

13.2 General Principles
  • Non-Refundable Fees: Service Fees collected by Wizfair are non-refundable regardless of outcome.
  • Additional to Airline/Supplier Charges: Fees are in addition to Supplier penalties, fare differences, taxes, etc.
  • Subject to Change: Fees may change without notice; the fee in effect at request time applies.
  • Per Passenger, Per Ticket: Applies individually unless stated otherwise.
13.3 Airline Refunds and Future Credits

Supplier rules prevail. Refunds/credits require Supplier eligibility and approvals. No-show status may eliminate eligibility.

13.4 Payment and Processing

Payment is due at request time before processing. Timing depends on Supplier responses; delays do not negate Service Fees.

13.5 No Guarantees

Wizfair cannot guarantee approval of refunds, credits, waivers, or modifications. Service Fees remain owed and non-refundable even if denied.

14. SERVICE-SPECIFIC TERMS

This Section applies to all Travel Services booked through Wizfair. These provisions supplement all other Terms and Supplier Rules. In case of conflict, Supplier rules govern the Supplier’s services. You acknowledge that each category involves distinct risks.

14.1 HOTELS AND ACCOMMODATIONS
14.1.1 Contractual Relationship
  • Your contract is directly with the Property owner/manager.
  • Wizfair is an intermediary and does not own/manage/inspect properties.
  • The Property is responsible for accommodation services.
14.1.2 Pricing Structure and Payment Models

(a) Prepaid / Pay Now: Wizfair or its payment partner collects at booking; refunds depend on Property cancellation policy.
(b) Pay Later: Property charges at check-in or per policy; disputes must be addressed with Property.

14.1.3 Incidental Deposits and Security Holds

Properties may require credit card and authorization holds. Holds are separate from prepaid booking; release timing depends on Property and card issuer.

14.1.4 Property Conditions and Representations

Descriptions/photos/ratings may come from Property or third parties. Wizfair does not guarantee cleanliness, noise, safety, accessibility, amenities, or description accuracy. Star ratings may vary by local standard.

14.1.5 No-Show and Early Departure

Failure to check in by deadline or early departure may result in cancellation/penalties and loss of refund eligibility.

14.1.6 Local Taxes and Mandatory Fees

Resort/destination/city/occupancy/environmental fees may be collected at check-in and may change; Wizfair is not responsible for increases.

14.1.7 Deposits at Check-In 

Some properties may require a credit card or cash deposit at check-in to cover incidentals; separate from any payment made to Wizfair.

14.1.8 No-Show Policies 

If you do not arrive for the first night but plan to use subsequent nights, you must inform Wizfair in advance; failure may cancel entire booking per property rules.

14.1.9 Group Bookings 

You may not book more than eight (8) rooms at the same property for the same dates through the Service. If exceeded, Wizfair may cancel bookings and possibly charge a cancellation fee. Group bookings may require separate contract and/or non-refundable deposit.

14.1.10 Property Ratings 

Ratings are general guidelines and may not reflect amenities/services in your home country; Wizfair does not guarantee rating accuracy.

14.1.11 Meals 

Meal plans are typically based on number of nights booked; no refunds for unused meals.

14.2 FLIGHTS (AIR TRANSPORTATION)
14.2.1 Airline Contract of Carriage

Your flight booking forms a direct contract with the operating airline. The airline controls schedules, substitutions, overbooking, boarding, baggage, and onboard services.

14.2.2 Schedule Changes and Irregular Operations

Airlines may change times/routes/aircraft. For weather/mechanical/government/crew disruptions, airlines determine re-accommodation and refund eligibility. Wizfair may assist but cannot compel outcomes.

14.2.3 No-Show and Missed Flights

No-show may cancel remaining segments and eliminate refunds; airline determines no-show status.

14.2.4 Separate Ticket Risk / Combined One-Way Tickets

Two one-way tickets may be offered; each ticket has independent rules. Missed connections across separate tickets are your risk; you may need to adjust the other flight at your own expense.

14.2.5 Baggage and Ancillary Services

Baggage/seats/meals/priority/upgrades are governed by airline policy and may change; additional charges may apply. Wizfair does not guarantee ancillaries unless confirmed by airline.

14.2.6 Travel Documentation

You are responsible for passports, visas, health documents, and check-in deadlines. Airlines may deny boarding for noncompliance.

14.2.7 Low-Cost Flights 

Some low-cost carriers may charge in different currencies; final amount may vary due to exchange rates and issuer fees. Some low-cost carriers require changes/cancellations directly with the airline; keep documentation.

14.2.8 Site Redirection 

You may be redirected to an airline’s website to complete booking/payment; if so, your contract is directly with that airline and Wizfair is not liable for those bookings.

14.2.9 Additional Flight Terms 
  • Seat allocation controlled by airline; no guarantee even if requested.
  • If outbound of roundtrip not used, airline may cancel return without refund.
  • Charter/special flight details may change; review Supplier rules.
  • Child travel rules apply; unaccompanied minors subject to airline terms.
  • Hazardous materials typically prohibited.
14.2.10 Air Miles and Vouchers

Frequent flyer miles/loyalty vouchers may not be redeemable through the Service; contact support for details.

14.2.11 Operating Airlines

Flights may be operated by a different airline than initially displayed; operating carrier should be shown during booking. Ticket-issuing airline charges may appear on statements.

14.2.12 Airport Taxes Refund Request

If eligible, certain airport taxes/fees may be refundable after no-show/cancellation. Contact Wizfair; we will submit to airline where applicable, subject to airline rules.

14.2.13 Airline Liability

Liability limits for injury/death/loss are governed by applicable law, treaties, and airline rules.

14.3 CAR RENTALS
14.3.1 Rental Agreement

Your contract is directly with rental provider; they control eligibility, vehicle class, insurance terms, and deposits.

14.3.2 Driver Requirements

Valid license, minimum age, and a credit card in driver’s name are typically required. Failure may result in refusal without refund.

14.3.3 Security Deposits and Holds

Providers may place holds/deposits; release timing depends on provider and issuer.

14.3.4 Insurance and Liability

Optional insurance may be offered by provider; Wizfair does not underwrite/administer.

14.3.5 Additional Charges

Fuel, tires, extra drivers, surcharges, child seats, delivery/collection fees may be payable at location; availability varies.

14.3.6 Collection and Use

Age limits may vary; additional documentation may be required; restrictions on cross-border/ferry travel may apply; return location typically same unless agreed otherwise.

14.3.7 Cancellations and Unused Days

No refunds for cancellations within six (6) hours of scheduled pickup or for unused rental days, subject to provider rules.

14.4 CRUISES
14.4.1 Cruise Line Contract

Governed by cruise line passenger contract; itineraries/ports/times/cabins may change.

14.4.2 Cancellation Penalties

Strict schedules; penalties may reach 100% after final payment deadlines.

14.4.3 Health and Safety Compliance

Vaccination/health screening/insurance may be required; noncompliance may result in denial without refund.

14.4.4 Liability Waivers

Some cruise providers may require liability waivers for participation.

14.5 TOURS AND ACTIVITIES (“THINGS TO DO”)

14.5.1 Independent Operators

Provided by third parties; Wizfair does not supervise safety/equipment/on-site operations.

14.5.2 Risk Assumption

You acknowledge inherent risks.

14.5.3 Liability Waivers

Operators may require waivers; failure may result in denial without refund.

14.5.4 Non-Transferable / Non-Refundable

14.6 VACATION PACKAGES
14.6.1 Component-Based Structure

Each component governed by its own Supplier rules; cancellation of one does not cancel others automatically.

14.6.2 Payment Allocation

Package payments may process in multiple transactions; total will not exceed displayed package price.

14.6.3 Disruption of Components

If one component is disrupted, others may remain non-refundable; each Supplier determines compensation/refunds.

15. INTERNATIONAL TRAVEL

You are responsible for:

  • Passport validity
  • Visa requirements
  • Vaccinations / health requirements
  • Entry compliance

Denied entry is not grounds for refund.

15.1 International Travel Risks

Review government travel warnings/advisories before booking and throughout travel. International travel is not risk-free; Wizfair is not liable for losses resulting from destination risks.

15.2 Health Requirements

You are responsible for vaccinations/inoculations, medications, and complying with entry health requirements; consult a healthcare professional.

15.3 Passenger Information Sharing

Some governments require airlines/cruise lines to provide passenger information; contact airline if questions.

15.4 OFAC / SANCTIONS COMPLIANCE

You represent that:

  • You are not located in or affiliated with sanctioned jurisdictions.

You are not on restricted party lists.
Wizfair may screen transactions and refuse service for sanctions compliance.

16. REVIEWS, COMMENTS, PHOTOS, AND USER SUBMISSIONS

By submitting reviews, photos, videos, comments, ideas, or other content (“Submissions”) to or about Wizfair, you confirm:

  • Your Submissions are your original work and you have necessary rights.
  • You grant Wizfair a non-exclusive, royalty-free, perpetual, transferable, irrevocable, fully sublicensable worldwide license to use, reproduce, modify, distribute, publish, translate, create derivative works, and publicly display/perform the Submissions in any media.
  • Wizfair may attribute (first name/city) but is not required.
  • You waive moral rights to the extent permitted by law.

Submissions must not be unlawful, defamatory, obscene, infringing, or commercial solicitation. Wizfair may remove/modify Submissions at any time.

17. CHARGEBACK & PAYMENT DISPUTES

If you initiate a chargeback for a valid booking:

  • We may dispute with documentation
  • We may suspend services
  • You remain responsible for supplier penalties

If chargeback is deemed invalid, you agree to reimburse:

  • Chargeback penalties
  • Administrative costs
  • Legal fees

Fraudulent disputes may result in legal action.

18. LIMITATION OF LIABILITY (COMBINED)

To the fullest extent permitted by law, Wizfair is not liable for:

  • Supplier acts or omissions
  • Schedule changes
  • Weather
  • Government actions
  • Insolvency
  • Indirect or consequential damages

Travel Providers are responsible for Travel Services they provide. Wizfair is not responsible for Supplier errors, negligence, personal injuries, death, property damage, or other losses arising from Supplier conduct.

Liability Cap

Maximum liability shall not exceed the greater of:

  • Service fees paid to Wizfair, or
  • $100 USD

Where a jurisdiction does not allow certain limitations, limitations apply to the maximum extent permitted by law.

No Warranty

Service and Travel Services are provided “as is” without warranties of any kind, including implied warranties of merchantability, fitness, title, or non-infringement, to the maximum extent permitted by law. Wizfair does not guarantee Service is free from viruses or harmful components.

19. FORCE MAJEURE

No liability for events beyond reasonable control including:

  • Natural disasters
  • Pandemics
  • Strikes
  • War
  • Infrastructure failures
  • Communication disruptions

Obligations affected may be suspended during force majeure.

20. INDEMNITY

You agree to indemnify and defend Wizfair and its officers, directors, employees, and agents from third-party claims, losses, damages, and expenses (including reasonable legal/accounting fees) arising from:

  • Your breach of these Terms or referenced documents
  • Your violation of law or third-party rights

Your use of the Service
to the extent not directly caused by Wizfair.

21. INTELLECTUAL PROPERTY, COPYRIGHT, AND TRADEMARKS

All content is owned by Wizfair or licensors. No scraping, mirroring, resale, or unauthorized use without consent.

Other names/brands may be trademarks of their owners. Wizfair is not responsible for external site content.

Translation tools (e.g., Google Translate) may be offered for convenience and may be inaccurate; use at your own risk.

If you believe content infringes your rights, contact us with details.

22. SOFTWARE ON OUR SERVICE

Software provided through the Service is owned by Wizfair or suppliers and protected by law. Use is subject to license terms; if none are provided, you receive a limited, non-exclusive, non-transferable license solely to access the Service.

Reproduction/redistribution is prohibited. Mapping tools may be subject to third-party terms; you agree to comply.

27. TRAVEL INSURANCE SERVICES (GENERALI)

Wizfair may offer travel insurance through a third-party partner (e.g., Generali). If you purchase insurance:

  • Your insurance contract is directly with the insurer, not Wizfair.
  • Wizfair does not guarantee coverage, claims approval/denial, or policy outcomes.
  • Questions/claims must be directed to the insurer.

Wizfair is not liable for denied claims, coverage limitations, refunds, disputes, or insurer delays/errors, or force majeure impacts on coverage.

28. DISPUTE RESOLUTION & ARBITRATION

28.1 Informal Resolution

You agree to first contact us and allow 30 days for resolution before initiating arbitration.

28.2 Binding Arbitration

Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in New Jersey, under applicable AAA consumer rules, except where prohibited by law.

28.3 No Class Actions

You agree disputes will be conducted on an individual basis and not as a class, consolidated, or representative action.

28.4 Jury Trial Waiver

You waive the right to a jury trial.

28.5 Small Claims Court

Small claims court remains available where applicable.

28.6 Costs and Fees

Your share of arbitration fees will be determined by AAA rules. If costs are prohibitive compared to litigation, Wizfair may cover certain fees as required to keep arbitration from being cost-prohibitive.

28.7 Severability of Arbitration Clause

If any part of this arbitration provision is unenforceable, the remaining parts remain in effect.

29. GOVERNING LAW

Governed by laws of the State of New Jersey, USA, without regard to conflict-of-laws principles. Arbitration is also governed by U.S. federal arbitration law where applicable.

30. GENERAL TERMS
30.1 No Waiver

Failure to enforce any provision does not waive the right to enforce later.

30.2 Severability

If any provision is invalid/unenforceable, it will be severed and remaining provisions remain valid.

30.3 Entire Agreement

These Terms constitute the entire agreement and supersede prior agreements/understandings.

30.4 Assignment

Wizfair may assign its rights/obligations. You may not assign without prior written consent.

30.5 Third-Party Rights

No third-party beneficiaries are created by these Terms.

30.6 Survival

Provisions that by nature should survive termination remain in effect.

30.7 Local Registrations

If additional local registrations or Seller of Travel disclosures apply, they will be provided on the Service.
